Probate During the Pandemic

Notwithstanding the COVID crisis, people continue to be born, people continue to pass away and the need for probate as well as Estate and Trust Administration continues.

The fact of the matter is, that except for emergencies, most pending Deceased Estate, Guardian and Conservatorship hearings are being rescheduled, postponed or at the very least experiencing long delays in being addressed. Individuals will continue to sign Wills, Trusts, Deeds and other documents that will continue to be possibly challenged in the future due to lack of capacity and or undue influence.

While there are still tools available to stop bad actors from profiting from the wrongdoing, the fact is that unless it is an emergency, during these challenging times, these types of issues will fester and require years to rectify.
